– All prices and charged are in US Dollars if the order is placed from the USA.
If the order is placed outside of the USA, pricing is in Canadian Dollars.
– We will warrant all workmanship on our products. This includes defects such as scratches to the prints, fading or warping. With genuine leather, by it’s nature there will always be minor imperfections, nicks and scars. We always aim to choose areas of the hide that have minimum damage, but we cannot warrant or guarantee defect free leather.
Limitation of Warranties: Please note that Albums and fine art prints require special handling and care. Albums or fine art prints which are damaged due to improper care or handling are not covered by our warranty, we are, however, always happy to help you with the repair.
We are only able to extend warranties to the original purchaser of the album and not to 3rd parties.
The customer should note that after 6 months from the time you receive your album, The Boudoir Album reserves the right to request that you provide evidential proof that damage to goods is due to manufacturing defects.
– Determination on the repair or replacement of goods is at the discretion of The Boudoir Album & does not include the cost of shipping.
– Albums should be cared for in accordance with our care, storage & maintenance instructions, failure to do so may void your warranty.
Color We use a 100% color calibrated workflow. However, due to the huge variety of monitors used to view images, we cannot guarantee that the color and density you view on your monitor will exactly match the final print. If exact color matching is a priority, please contact us and we will be happy to work with you to produce test prints of your file.
– All orders must be submitted online and prepaid by credit card or PayPal account. There are no terms or accounts available, Should an order be placed incorrectly, the purchaser must pay the balance prior to the order being produced. Our turnaround time will only begin once the order is paid in full.
If your credit card creates delays, we will only begin production once payment goes through.
– Your order may be cancelled and a full refund issued as long as your order has not gone into production. Our production times vary and can commence anywhere from an hour after receiving your order to two business days. If you require an order within 7 business days, please call us directly at 1-855-573-1096 prior to ordering to ensure we are able to fulfill your order within the requested timeframe. Once a team member approves your rush order, submit your order immediately and add in your order notes the date you require the album by. The rush order fee is a flat fee of $80 per product, and $120 during our busy seasons (Christmas and Valentine’s Day). Please note that the date requested does not guarantee you will receive it by then. If there are issues, we will notify you. If you request a rush but do not specify a need-by date, we will not process your order as a rush.
Turnaround times – Due to changing nature of volumes, turnaround times indicated may vary. Please give yourself and your clients reasonable time to expect the orders. Our standard turnaround time for all products will be available on our website, and will change from time to time based on order flow and seasonality.
— Our default shipping is USPS or UPS. The choice is usually based on cost. USPS normally takes 3 – 4 business days. However, this can very widely depending on time of year, weather and final destination.
— The Boudoir Album is not responsible for any potential damage during shipping. If damage does occur, please get in touch with our customer service team to file a claim and potentially replace the product. Photographs of the damage to the packaging, label and product must be shown as proof and emailed to us. Once approved, remakes will be done within the same turnaround and shipping service as the original order.
— Shipping insurance – Standard insurance with the carriers is $100 + cost of shipping.
Remakes will be done when there is an error or damage to an order. This includes material defect or workmanship. If there is an error with your item, please email within fourteen days of receiving your product with a photograph of the damage. The Boudoir Album will then determine if a remake is necessary. Remakes may only be done for the same product and from the original files submitted in the order. Remakes will not be done with new files or new cover materials. Remake orders will have the same turnaround times and will be shipped the same method as the original order. If you wish to make modifications to the files or services, you will need to place a new order at your cost.
Overnight or rush shipping is available – please contact us for a specific quote.
We do offer drop-shipping. Certain carriers require commercial invoices with the shipment. This is a legal requirement. If this is a concern please contact us to discuss and agree options. Is this still true?
In accepting your photograph, digital files or original artwork (the “Material”) for printing, processing, copying or other handling, The Boudoir Album and its subsidiaries assume no liability for copyright infringement. By submitting any material to The Boudoir Album you expressly represent and warrant that such Material is original and does not violate any law or infringe on the rights of any person, or that such reproduction is being done with the express consent of the copyright owner, or that such Material is in the public domain. You agree to indemnify and save The Boudoir Album harmless from any and all liability, claims, demands, loss and damage (including reasonable outside legal fees and costs) arising out of or connected with any claim or action which is inconsistent with the warranties and representations made by you herein.
We will print all appropriate boudoir related imagery. We will not print any content that is illegal or shows illegal activity.
Due to the nature of the content, we will delete all files after 4 weeks from the date of the order. Should you need a reprint after that time you will need to re-submit the files.
Limitation of Liability We understand the very personal and sensitive nature of the content, and we take all reasonable precautions to protect all images. However, we are not responsible for any liability from images that may be stolen, hacked or otherwise illegally obtained or obtained in bad faith. We are also not liable for any damages or lawsuits that may arise from any images being unscrupulously taken from The Boudoir Album or any of our suppliers.
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion. By continuing to access or use our services after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
